    Is the current concept of security of tenure outdated in todayā€™s commercial landscape?

    The Landlord and Tenant Act 1954 provides business tenants rights to renew their tenancies at the end of each term, known as security of tenure. However, the legislation is nearly 70 years old. ASA - 2 major adjudications on (i) HFSS promotions and under 16s and (ii) use of terms rustic, traditional, authentic etc. Finally enforcement; focus on meat sector, sustainability and never obstruct an officer.

    Claims ā€œrusticā€, ā€œtraditionalā€ and ā€œauthenticā€ examined by ASA

    Voluntary claims such as 'traditional' 'authentic' and 'rustic' were examined by the Advertising Standards Authority (ASA). The ruling highlighted the importance of context and specifying what part of the product or process the claim may relate to.Ā  The ASA maintained their position that a consumer would have broad understanding of industrial mass production. Also, the importance for producers to have substantiated all the claims they use.

    Direct marketing restriction of HFSS foods to under-16s

    A recent ASA adjudication on Burger King ads looked at the requirements on marketers not to promote HFSS products to under 16s.Ā  It found that practical steps to actively exclude those who were under 16 were necessary, over and above simply stating the offer was not open to them, when it came to the creation of a mailing list for direct marketing.

    New Allergen Guidance expected for Restaurants and Cafes

    The Food Standards Agency (FSA) is backing calls for 'Owen's Law' and will introduce guidance for food businesses of non-prepacked foods ie cafes and restaurants, on how best to provide written allergen information. In light of this strong steer and promised guidance those FBO's serving non-prepacked food should be alert to the format with which they provide their allergen information to customers.
